Terms of Service — GunzDepot

1. Acceptance of Terms

By accessing or using GunzDepot ("Service"), operated by GunzDepot LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of any modified Terms.

2. Description of Service

GunzDepot is an online directory of Federal Firearms License (FFL) dealers in the United States. The Service allows users to search for FFL dealers, read reviews, and access dealer information. FFL dealers may claim and manage their business profiles, respond to reviews, and subscribe to premium features. We also provide an API for third-party integrations.

Important: GunzDepot does not sell firearms, ammunition, or any regulated items. We are an information directory only. All firearm transactions must be conducted directly with licensed FFL dealers in compliance with all applicable federal, state, and local laws.

3. User Accounts

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our sole discretion.

4. FFL Dealer Profiles

FFL dealers may claim their business profiles by verifying their identity and license status. By claiming a profile, dealers represent and warrant that:

They hold a valid, current Federal Firearms License
They are authorized to represent the business
All information provided is accurate and not misleading
They will maintain compliance with all applicable laws and regulations

We reserve the right to remove or suspend any dealer profile that violates these Terms, contains inaccurate information, or is associated with a revoked or expired FFL.

5. User Content and Reviews

Users may submit reviews and other content ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such content in any media. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

You agree not to submit content that:

Is false, misleading, defamatory, or fraudulent
Infringes any intellectual property or other rights
Is obscene, threatening, harassing, or discriminatory
Violates any applicable law or regulation
Contains malware, spam, or unauthorized advertising
Impersonates any person or entity

We reserve the right to remove any User Content at our sole discretion without notice or liability.

6. Subscriptions and Payments

Certain features require paid subscriptions. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are non-refundable except as required by law or at our sole discretion. We may change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your subscription.

Promotional codes and discounts are subject to specific terms and may be revoked if obtained through fraud or misrepresentation.

7. API Usage

Access to our API is subject to these Terms and any additional API-specific terms. API users agree to:

Use API keys only for authorized purposes
Not exceed rate limits or attempt to circumvent restrictions
Not resell, redistribute, or sublicense API access without authorization
Maintain the security of API credentials
Attribute data to GunzDepot where required

We may suspend or terminate API access for violations, abuse, or at our discretion. API availability is provided "as is" without guaranteed uptime.

8. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof—are the exclusive property of GunzDepot or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT VERIFY THE ACCURACY OF FFL DEALER INFORMATION, LICENSE STATUS, OR USER REVIEWS. USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUNZDEPOT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless GunzDepot and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

12. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Miami, Florida. The arbitrator's decision shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. General Provisions

These Terms constitute the entire agreement between you and GunzDepot regarding the Service. Our failure to enforce any right or provision shall not be deemed a waiver. If any provision is found unenforceable, the remaining provisions shall continue in effect. You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
